Complaints and Legal Sufficiency
Discipline begins with a complaint filed with DBPR. DBPR investigates if the complaint is legally sufficient, meaning it contains ultimate facts which, if true, show a violation of Chapter 475, Chapter 455 or FREC rules. Anonymous complaints may be investigated if written, legally sufficient, alleging a substantial violation, and DBPR believes after preliminary inquiry the allegations are true. Trap: legal sufficiency is about whether the facts, if true, would be a violation, not whether they have been proven.
