Real Property Defined

Chapter 475 defines real property as any interest or estate in land and any interest in business enterprises or business opportunities, including assignments, leaseholds, subleaseholds and mineral rights. It excludes cemetery lots and burial rights, and the renting of a mobile home or RV lot in a park. Physically, real estate is the land (surface, subsurface and air space), plus improvements permanently attached, plus appurtenances such as easements. Real property transfers by deed; personal property (chattels) transfers by bill of sale.
