The Brokerage Relationship Disclosure Act

Florida licensees may deal with the public in only three ways: as a transaction broker, as a single agent, or with no brokerage relationship. The law presumes every licensee is a transaction broker unless a single agent or no brokerage relationship is established in writing. Dual agency, being a single agent for both buyer and seller in the same deal, is not allowed in Florida. The written disclosure rules apply to residential sales, but the transaction broker presumption applies to all licensees.
