The Duty to Disclose Material Facts

A material fact is any fact that would affect the value or desirability of the property to a reasonable buyer. Material facts must be disclosed to both parties. Examples: structural defects, leaky roof, foundation problems, flooding history, environmental hazards, zoning violations, pending assessments, neighborhood issues, and known defects of any kind. The duty applies to facts known to the seller and facts that the agent discovered through the visual inspection.
