Requirements for a Valid Deed
A valid deed requires: (1) Competent GRANTOR (person transferring). (2) GRANTEE capable of holding title. (3) WORDS OF CONVEYANCE (granting clause). (4) LEGAL DESCRIPTION of the property. (5) GRANTOR'S SIGNATURE. (6) DELIVERY and ACCEPTANCE. Consideration is not required for the deed itself but typically required for the underlying transaction. The deed does NOT need to be recorded to be valid between the parties, but recording protects the grantee against later claims.
