Purpose of Buyer Representation Agreements
A buyer broker agreement (buyer representation agreement or BRA) creates a contractual agency relationship between the buyer and the broker. Since January 1, 2025, a licensee acting as a buyer's agent must have a written buyer-broker agreement signed as soon as practicable and no later than the buyer's offer (Civil Code §1670.50); MLS rules also require a written agreement before touring a home. The BRA clarifies that the licensee represents the buyer.
