Duty of Honesty and Fair Dealing
While an agent owes fiduciary duties only to the principal, the agent still owes a duty of honesty and fair dealing to non-client third parties in the transaction. This means the agent cannot lie to the other party, cannot withhold material facts about the property, and cannot commit fraud. This is a lower standard than the fiduciary duty owed to the principal, but it is still a legal duty.
