Probate Basics

Probate is the court-supervised process of administering a deceased person's estate. In California, property held solely by a decedent generally must go through probate UNLESS held in: (1) Joint tenancy, (2) Community property with right of survivorship, (3) Revocable living trust, (4) Transfer-on-death deed, or (5) Small estate affidavit procedure (for estates under $184,500, adjusted).
